The objectives of the Legal Services Department are to render support to the Board, CEO and the line function Departments of the MGB; provide legal advice and render company secretariat services to the Board. The Department makes recommendations regarding amendments to the MGB Act, Regulations and Rules, evaluates licensees' jobs compediums, as well as applications for dispensations on the MGB Rules and licensees' ICP's.

The functions of the Legal Services Department include:

  • Render legal advice to the MGB and the Board;
  • Make recommendations regarding amendments to the MGB Act, Regulations and Rules, to ensure that the MGB legislation is effective and inline with national and international norms and standards.
  • Ensure that the MGB operates within the ambits of the MGB and National legislation and common law.
  • Represent the MGB at enquiries, hearings and disciplinary proceedings against licensees, which may lead to the revocation of a licence, key employee or employee registration.
  • Evaluate and making recommendations regarding jobs compendiums of licensees.
  • Evaluate all requests and applications for dispensations on the MGB Rules and licensees' ICP's and maintaining a database of all dispensations granted by the Board;
  • Assist the Board in litigation matters.
  • Draft and review agreements, and
  • Render secretariat services to the Board and ensure that the Board operates in accordance with corporate governance principles and guidelines.
